These Terms of Service ("Terms") govern your access to and use of services provided by XY Zinc ("we," "us," or "our"), a brand of Chaos Unlimited LLC. By accessing or using our services, you agree to be bound by these Terms.

• "Services" refers to the XY Zinc Age Verification API and related tools provided by XY Zinc
• "Customer" or "Tenant" refers to businesses or individuals who integrate our API into their platforms
• "End User" refers to visitors who complete age verification on a Customer's website
• "API" refers to our Application Programming Interface and associated documentation

2. API Access and Use

2.1 Account Registration

To use our Services, you must register for an account and receive API credentials. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your API keys and credentials
• Notify us immediately of any unauthorized use
• Accept responsibility for all activity under your account

2.2 Permitted Use

You may use the Services to verify the age of visitors to your website or application where age verification is required by law or your own policies. You agree to:

• Use the Services only for lawful purposes
• Comply with all applicable laws and regulations regarding age-restricted content
• Implement the verification flow as documented
• Not attempt to circumvent or disable any security features

2.3 Prohibited Use

You may NOT use the Services to:

• Collect or store End User biometric data beyond what our system provides
• Circumvent age verification for minors
• Resell or redistribute API access without authorization
• Interfere with or disrupt the Services or servers
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems to abuse API rate limits
• Facilitate illegal activity of any kind

3. Service Levels and Availability

3.1 Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability.

3.2 Rate Limits

API access may be subject to rate limits based on your subscription tier. Exceeding these limits may result in temporary throttling or suspension.

3.3 Changes to Services

We reserve the right to modify, update, or discontinue any aspect of the Services with reasonable notice. Material changes will be communicated via email or through our API documentation.

4. Fees and Payment

4.1 Pricing

Fees for the Services are as specified in your service agreement or order form. Pricing may include base subscription fees, per-verification fees, or both.

4.2 Payment Terms

Invoices are due within 30 days of issuance unless otherwise specified. Late payments may incur interest at 1.5% per month or the maximum rate permitted by law, whichever is lower.

4.3 Taxes

All fees are exclusive of taxes. You are responsible for any applicable sales, use, VAT, or similar taxes.

As a Customer integrating our Services, you are responsible for:

• Determining whether age verification is required in the jurisdictions you operate
• Configuring appropriate regional rules for your use case
• Providing clear privacy disclosures to your End Users about the verification process
• Handling verification results appropriately (granting or denying access)
• Maintaining the security of verification tokens and cookies
• Complying with all laws applicable to your content and operations

We provide the verification tools; you remain responsible for how you use them and for compliance with laws governing your business.

6. Intellectual Property

6.1 Our Property

The Services, including all software, APIs, documentation, and branding, are owned by XY Zinc / Chaos Unlimited LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

6.2 Feedback

If you provide suggestions, feedback, or ideas about our Services, we may use them without obligation to you.

7. Data Protection

Our handling of End User data is governed by our Privacy Policy. Key points relevant to these Terms:

• We do not store biometric images or personal identification data from ID documents
• We store only anonymous session records and verification results
• You must inform your End Users that verification is handled by a third-party service
• We process data as a data processor on your behalf for verification purposes

• Your violation of any law or third-party rights
• Claims by your End Users related to your use of the Services

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us. Termination does not relieve you of obligations to pay outstanding fees.

11.2 Termination by Us

We may suspend or terminate your access if you:

• Violate these Terms
• Fail to pay fees when due
• Engage in fraudulent or illegal activity
• Use the Services in ways that harm our systems or other customers

11.3 Effect of Termination

Upon termination, your API access will be revoked. Sections of these Terms that should survive termination (such as indemnification, limitation of liability, and dispute resolution) will remain in effect.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the matter informally for at least 30 days.

12.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will be conducted in Delaware. You waive the right to participate in class actions.

These Terms, together with the Privacy Policy and any service agreements, constitute the entire agreement between you and XY Zinc.

If any provision is found unenforceable, the remaining provisions continue in effect.

13.4 Assignment
